Acceptance of Terms

By creating an account or using Magic Eat Ball (the “App”), you agree to these Terms. If you don’t agree, do not use the App.

Service Description

Magic Eat Ball is a Progressive Web App that helps users decide where to eat via a magic-8-ball-style shake mechanic, games, and restaurant suggestions.

Eligibility

You must be 13+ (or 16+ in EU) to use the App.

​Subscriptions & Payments

• • Monthly: $1 USD
  • Annual: $5 USD (or $4 first year with referral)
  • Lifetime: $15 USD one-time
  • Processed via Stripe. Non-refundable except as required by law.
  • Free 30-day trial granted to every new account. Trial converts automatically unless canceled.

License

We grant you a limited, non-transferable license to use the App for personal, non-commercial purposes.

User Conduct

You may not:

• • Reverse-engineer, scrape, or automate the App
  • Create multiple accounts to abuse trials or referrals
  • Use the App for commercial solicitation without written permission

Termination

We may suspend or delete your account for any reason, with or without notice.

Disclaimers

THE APP IS PROVIDED “AS-IS”. We do not guarantee restaurant accuracy, availability, or that you’ll actually like the food. Magic Eat Ball is for entertainment only.

Limitation of Liability

To the maximum extent permitted by law, FOOD CHOICE, LLC shall not be liable for any indirect, incidental, or consequential damages. Total liability capped at what you paid us in the last 12 months.

Governing Law

South Carolina, USA (without regard to conflict of laws).

Changes

We may update these Terms. Continued use = acceptance.

PRIVACY POLICY

We respect your privacy. This policy explains exactly what we collect — nothing more.

Information We Collect

Account Data

• • Email address (required for login)
  • Hashed password (never stored in plain text)
  • Optional: referral code used

Aggregate & Anonymous Usage Data (NO personal identifiers)

• • Total shakes per day
  • % of users who watch processing videos vs. skip
  • % who play Food Fight or Wheel puzzles
  • Subscription conversion rates
  • Trial start/end counts
  • Geographic patterns by ZIP code only (never street-level)
  • Device type / OS version
  • Time spent in app

Payment Data

Handled 100% by Stripe. We never see or store your credit card.

How We Use Data

• • Improve the App (e.g., “80% skip videos → let’s make them shorter”)
  • Show sponsors aggregate stats (“Your ad reached 12,400 pizza searches in 90210 last month”)
  • Prevent fraud (e.g., multiple trials from same device)

Data Sharing

• • Never sold to third parties.
  • Shared only with:
    • Stripe (payment processing)
    • Base44 (our backend provider)
    • Restaurant sponsors (aggregate stats only, never emails)
    • Legal authorities if required by law

Cookies & Tracking

We use localStorage (PWA) for your preferences and session. No third-party tracking pixels except:

• • Mixpanel/Amplitude (anonymous events)
  • Stripe (payment only)

Your Rights (CCPA / GDPR)

• • Access: email privacy@themagiceatball.com
  • Deletion: delete account in Settings → we erase everything within 30 days
  • Opt-out of aggregate stats: impossible (they’re already anonymized)

Children

We do not knowingly collect data from children under 13 (16 in EU). Accounts will be deleted if discovered.

Security

Industry-standard encryption, regular security audits.

Changes

We’ll email you if we ever plan to collect new types of data.
